1. Acceptance of Terms

By accessing our website or utilizing our services, you acknowledge that you have read, understood, and agree to be bound by these comprehensive Terms and Conditions.

2. Services & Project Scope

IT Promax provides web development, data analysis, app development, networking, and maintenance. Any request outside the documented Service Agreement:

• Is considered strictly out-of-scope.
• Requires formal written approval via email or signature.
• Will result in increased project costs based on complexity.
• May result in an automatic extension of the delivery timeline.

3. Timelines & Client Responsibilities

Timely delivery is a collaborative effort. Clients must provide accurate data and access to resources as requested. Delays caused by late feedback, pending approvals, or overdue payments will automatically extend the project timeline and may incur additional administrative fees.

4. Design Phase & “Freeze” Policy

• Revision Limits: Projects include a maximum of two (2) rounds of minor revisions. Extensive re-designs or “starting over” are not included in fixed-price quotes.
• Design Freeze: Once the Client provides approval (via email, digital signature, or WhatsApp text/voice message), the visual identity is considered “Frozen” and final. Subsequent modifications will incur additional charges.

5. Compliance with Islamic Principles

IT Promax operates under a commitment to Islamic principles. We reserve the right to decline any project or specific content that contradicts these teachings. In such instances, no refunds will be issued for work performed.

6. Payments & Service Suspension

Fees are detailed in your specific Service Agreement. IT Promax reserves the right to suspend services or disable access to websites, servers, or codebases until all outstanding payments are resolved in full.

7. Third-Party Integrations

As an integrator of services (e.g., DigitalOcean, Amazon SES), IT Promax is not liable for:

• Third-party outages, data loss, or performance degradation.
• Blacklisting of domains/IPs caused by Client content or email behavior.
• External pricing changes or API policy updates released after the agreement date.

8. Liability & Maintenance

IT Promax is not responsible for issues arising from Client-side misuse, unauthorized code modifications, or third-party browser/software updates released after the project completion date.

9. Indemnification

The Client agrees to defend and hold harmless IT Promax from claims, liabilities, and legal fees arising from the legality of Client-provided content or GDPR/data privacy violations related to the Client’s management of recipient lists.

10. Portfolio & Branding

IT Promax reserves the right to include a discrete “Powered by IT Promax” link in website footers and to include project summaries in our professional portfolio.

11. Refund Policy

• 14-Day Window: Refund requests must be submitted within 14 days of service delivery.
• Criteria: Refunds are only considered if the delivery significantly deviates from agreed specifications.
• Exclusions: Completed services and additional edits beyond the initial scope are strictly non-refundable.
